Common questions

What is a contingency fee?

A fee paid as a percentage of what you recover. If you recover nothing, you generally owe no fee, though the agreement should say what happens to case costs. Illinois requires a contingent fee agreement to be in writing, and it must explain how the fee is calculated and whether expenses come out before or after the fee.

What percentage do injury lawyers usually charge?

It varies by firm and case, and it is negotiable. Agreements often set a higher percentage if the case goes to trial or appeal, so read the tiers. Some states also limit fees for particular kinds of case, so ask the lawyer what applies to yours.

Does it matter if costs come out before or after the fee?

Yes. If the percentage is taken before costs come out, the lawyer's share is calculated on a larger number and you take home less. Use the toggle in the calculator to see the difference on your numbers.

Is this what I will actually receive?

It's an estimate. Medical liens, insurance reimbursement and taxes can reduce what you take home, and they aren't included here. Ask the firm for a written settlement statement before you accept any offer.
